1. General Terms and Conditions
1.1 These general terms and conditions apply to all services and products of Danique Byoux.
1.2 By using the services and products of Danique Byoux, you automatically agree to these terms and conditions.
1.3 The owner may amend these terms and conditions at any time.
1.4 The owner is not liable for material damage or physical injury to persons or animals.
1.5 If you object to these terms, you must submit your objection in writing to Danique Byoux before purchasing products or services.

2. Bookings
2.1 Bookings are made via email, WhatsApp, or the Danique Byoux website.
2.2 Travel costs are not included in the price.
2.3 Payments are made via bank transfer, unless another arrangement has been agreed upon, and must be made in advance of the shoot or on the day itself.
2.4 No photos will be delivered if payment is not made.
2.5 A booking cannot be canceled by you as a customer. Exceptions may apply. The photographer has the right to cancel a shoot.
2.6 If the photographer cancels your shoot, you will receive a full refund, except in cases where the customer has failed to meet agreements.
2.7 In case of (late) cancellation, the photographer is entitled to 50% of the agreed price.
2.8 If the shoot is canceled due to bad weather, no costs will be charged, unless you request the photographer to still come, in which case you will pay for the costs incurred by the photographer.
2.9 Cancellations can be made up to 48 hours in advance.

3. Photo Shoots
3.1 The photographer is free to apply her own artistic knowledge and insights in the shoots.
3.2 You are booking the photographer for her style, but she is free to alter this style between shoots.
3.3 The photographer may make her own pre-selection of photos for you. You have no claim to photos that did not make it through the pre-selection.
3.4 Web files delivered to you are not for printing and may under no circumstances be published on the internet without the logo.
3.5 High-quality files will be delivered without a logo for printing and may under no circumstances appear on the internet.
3.6 No changes may be made to the photos by the client after delivery.
3.7 The delivered photos are not for commercial purposes by the client.
3.8 The photos in the selection gallery are not meant for distribution and must not appear outside of the selection gallery.

4. Payment & Delivery Time
4.1 By placing an order, you automatically agree to the payment terms. These terms apply to all orders.
4.2 After receiving your order, it will be processed as soon as possible. Payment can be made in cash on the day or via bank transfer.
4.3 The payment term for your invoice is 7 days, unless agreed otherwise. If the payment is not made or is only partially paid within the payment term, the outstanding amount will be increased by 5 euros administration costs.
4.4 The delivery time may vary per product. You can always request an estimated delivery time.
4.5 Refunds are only possible by mutual agreement.
4.6 No refunds are possible for handmade products.
4.7 We aim to contact you about your order within 2 business days.

5. Copyright & Publication
5.1 Copyright and other rights granted to the photographer under Dutch law are and will always remain the property of Danique Byoux Photography.
5.2 If you wish to use the photos for publication, you must contact the photographer in writing and demonstrate proof of this request.
5.3 All delivered photos are subject to copyright by the photographer. You are purchasing a photo print or a digital photo, not the rights to the photo.
5.4 Digital files in original size without a logo are for personal use only and may not appear on the internet under any circumstances. Web versions should be used for this purpose.
5.5 Digital files in original size may not be shared with third parties.
5.6 The photographer may use, sell to third parties, reproduce, and publish the photos for both commercial and non-commercial purposes at her discretion. The photographer is not required to inform the owner, but will attempt to notify them.
5.7 Any agreed-upon publication must clearly include the credit: “Photo: Danique Byoux Photography.” If this condition is not met, an additional fee of 100% of the amount will be charged.

6. Return & Shipping Policy
6.1 We at Danique Byoux always strive to deliver our products as quickly as possible. We send them with track and trace, but are dependent on supplier delivery times.
6.2 It is always possible to request an estimated delivery time.
6.3 Our products cannot be returned under any circumstances. They are handmade, so we cannot accept returns.
6.4 The only exception for returns is if a product is incorrect.
6.5 A refund is not possible, but you will receive a voucher or a replacement product.
